1. Who We Are
GetnDrive ("the Platform", "we", "us", "our") is an online vehicle rental information and booking referral platform available at getndrive.com. The Platform is operated by Nikolay Egorov, a private individual ("the Operator").
We may transfer the operation of the Platform, together with all rights and obligations under these Terms, to a legal entity established for that purpose. Such transfer does not affect your rights under these Terms; notice will be given by publication of updated Terms on this page.
2. Definitions
- "Partner" — an independent vehicle rental company listed on the Platform that owns or operates the vehicles and provides rental services.
- "Customer", "you" — a person using the Platform to find vehicles and submit booking requests.
- "Booking Request" — a request submitted through the Platform to rent a vehicle from a Partner.
- "Rental Agreement" — the agreement for the rental of a vehicle concluded directly between the Customer and the Partner.
3. Nature of the Service
The Platform provides information about vehicles offered for rent by independent Partners and transmits Booking Requests from Customers to the relevant Partner.
The Platform does not own, operate, insure, inspect, or maintain any vehicles, does not provide rental, transport, or driver services, and is not a party to any Rental Agreement. Each Rental Agreement is concluded directly and exclusively between you and the Partner identified in your booking.
The Operator acts solely as a technical intermediary transmitting information between Customers and Partners. Nothing in these Terms creates an agency, partnership, employment, or joint venture relationship between the Operator and any Partner or Customer.
4. Bookings
A Booking Request submitted through the Platform is an enquiry only and does not constitute a confirmed reservation or a contract. A booking becomes binding only when the Partner confirms it to you directly (including via messaging channels such as WhatsApp, Telegram, email, or telephone).
All terms of the rental — including vehicle availability, rental rates, security deposits, fuel policy, insurance coverage, driving licence and age requirements, delivery, pick-up and return conditions — are determined solely by the Partner and form part of the Rental Agreement between you and the Partner.
You are responsible for reviewing and understanding the Partner’s rental conditions before entering into a Rental Agreement, and for ensuring that you hold a driving licence valid for the vehicle category and jurisdiction concerned and comply with applicable insurance requirements.
5. Payments
The Platform does not collect, process, hold, or transmit any payments from Customers. All payments for rentals, deposits, and any related charges are made by you directly to the Partner, using the payment methods offered by that Partner.
Any payment disputes, refunds, deposit returns, or charges for damage, fuel, traffic fines, or late return are matters strictly between you and the Partner under the Rental Agreement.
6. Cancellations and Changes
Cancellation, amendment, no-show, and refund conditions are set by each Partner and communicated to you by the Partner upon confirmation of the booking. If you wish to cancel or change a booking, contact the Partner directly; you may also notify us so that we can update our records.
7. Customer Obligations
By using the Platform you confirm that you are at least 18 years old and legally capable of entering into contracts. You agree to:
- provide accurate, current, and complete information in Booking Requests;
- use the Platform only for lawful purposes and genuine booking enquiries;
- not submit fraudulent, speculative, or automated requests;
- not copy, scrape, reverse engineer, or otherwise extract data from the Platform;
- not interfere with the operation or security of the Platform.
We may refuse service, remove content, or restrict access to the Platform at our discretion where we reasonably believe these Terms have been breached.
8. Information on the Platform
Vehicle descriptions, photographs, prices, and availability displayed on the Platform are provided by Partners. While we ask Partners to keep their information accurate and up to date, we do not independently verify it and do not warrant its accuracy, completeness, or currency. The vehicle and conditions actually provided are those agreed in your Rental Agreement with the Partner.
The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Operator is not liable for:
- the condition, safety, legality, or roadworthiness of any vehicle;
- the acts or omissions of any Partner, including failure to honour a confirmed booking;
- any accident, injury, loss, damage, fine, or penalty arising out of or in connection with a rental or the use of a vehicle;
- insurance coverage, deposit disputes, or any other matter arising under a Rental Agreement;
- indirect, incidental, consequential, or punitive damages, or loss of profit, arising out of the use of the Platform.
Where liability cannot be excluded by law, the Operator’s aggregate liability in connection with the Platform is limited to THB 2,000 or the minimum amount permitted by law, whichever is greater. Nothing in these Terms excludes liability that cannot be excluded under Thai law, including liability arising from wilful misconduct or gross negligence.
10. Indemnity
You agree to indemnify and hold harmless the Operator from claims, liabilities, and reasonable expenses (including legal fees) brought by third parties arising out of your breach of these Terms or your unlawful use of the Platform.
11. Intellectual Property
The Platform, including its software, design, text, graphics, logos, and the GetnDrive name and marks, is the property of Nikolay Egorov or is used under licence. Except for viewing the Platform for personal, non-commercial use, no rights are granted to you. You may not use the GetnDrive name or marks without prior written consent.
Vehicle photographs and Partner descriptions remain the property of the respective Partners and are displayed on the Platform with their permission.
12. Privacy
Our collection and use of personal data in connection with the Platform is described in our Privacy Policy, which forms part of these Terms. In particular, personal data you submit in a Booking Request is shared with the relevant Partner for the purpose of arranging your rental.
13. Third-Party Links and Communications
The Platform may contain links to third-party websites and messaging services (including Partner websites, WhatsApp, and Telegram). We are not responsible for the content, terms, or privacy practices of third-party services.
14. Changes to These Terms
We may amend these Terms from time to time. The current version, with its effective date, is published on this page. Amendments apply to Booking Requests submitted after the effective date of the amended Terms. Your continued use of the Platform after publication constitutes acceptance of the amended Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising out of or in connection with these Terms or the Platform that cannot be resolved amicably shall be submitted to the competent courts of Thailand.
For the avoidance of doubt, disputes arising under a Rental Agreement are between you and the Partner and are governed by the terms of that Rental Agreement.
16. General
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Operator regarding the use of the Platform.
These Terms are made in English. Translations into other languages are provided for convenience only; in the event of any discrepancy, the English version shall prevail.
